These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Food-TruckHub ("Company," "we," "us," or "our"). By creating an account, accessing, or using the Food-TruckHub application or website, you confirm that you are at least 13 years of age and have the legal capacity to enter into this agreement.

We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We will notify users of material changes via the app or email where reasonably practicable.

Food-TruckHub is a mobile and web platform that connects customers with local food trucks, mobile vendors, and food service businesses. The Service allows customers to discover vendors, view menus and schedules, and receive location-based alerts. Vendors may create and manage business profiles, post schedules, and interact with customers.

We do not process food orders, facilitate payments between customers and vendors, or guarantee the availability, quality, or safety of any food or service offered by vendors listed on the platform.

To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information and to keep your account credentials confidential. You are solely responsible for all activity that occurs under your account.

You must notify us immediately at [email protected] if you suspect unauthorized use of your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account.

Vendors who create business listings on Food-TruckHub agree to the following:

• All information provided in your profile, menu, and schedule is accurate and up to date.
• You hold all required licenses, permits, and certifications to operate your food business in your jurisdiction.
• You are solely responsible for compliance with all applicable food safety, health, and business regulations.
• You will not post false, misleading, or deceptive information about your business or products.
• You will not use the platform to engage in any fraudulent, illegal, or harmful activity.
• You are responsible for all content you upload, including photos, menus, and descriptions.

Food-TruckHub reserves the right to suspend or remove any vendor listing that violates these Terms or that we determine, in our sole discretion, is harmful to users or the platform.

Food-TruckHub offers both free and paid subscription plans for vendors. Paid plans are billed on a monthly or annual basis through our payment processor, Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.

Free Trial: New vendors receive a 60-day free trial of Pro features. After the trial period, your account will automatically revert to the free tier unless you have subscribed to a paid plan.

Cancellations: You may cancel your subscription at any time through your vendor dashboard or by contacting us. Cancellations take effect at the end of the current billing period. We do not offer refunds for partial billing periods.

Hibernate Mode: Seasonal vendors may pause their listing using the Hibernate feature. Your profile, menu, and reviews are preserved during hibernation. Subscription billing continues during hibernation unless you cancel your plan.

Price Changes: We reserve the right to change subscription pricing with at least 30 days' notice. Continued use of the paid service after a price change constitutes acceptance of the new pricing.

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation.
• Post or transmit any content that is false, misleading, defamatory, obscene, or harmful.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Scrape, crawl, or systematically extract data from the Service without our express written permission.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Use automated tools, bots, or scripts to interact with the Service.
• Harass, threaten, or harm other users or vendors.

By submitting reviews, photos, comments, or other content ("User Content") to the Service, you grant Food-TruckHub a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your User Content in connection with operating and promoting the Service.

You represent that you own or have the necessary rights to submit your User Content and that it does not infringe any third-party intellectual property, privacy, or other rights. We reserve the right to remove any User Content that violates these Terms or that we find objectionable.

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, and software — are the exclusive property of Food-TruckHub or its licensors and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or its content without our prior written consent.

The Service uses your device's GPS location to show nearby vendors and provide location-based alerts. Location access is optional and requires your explicit consent. You may disable location access at any time through your device settings. Disabling location access will limit certain features of the Service.

We collect and use location data as described in our Privacy Policy.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

FOOD-TRUCKHUB IS NOT RESPONSIBLE FOR THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY VENDOR INFORMATION, MENU ITEMS, SCHEDULES, OR LOCATIONS LISTED ON THE PLATFORM. WE ARE NOT A PARTY TO ANY TRANSACTION BETWEEN CUSTOMERS AND VENDORS.

TO THE FULLEST EXTENT PERMITTED BY LAW, FOOD-TRUCKHUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Food-TruckHub and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your User Content, your violation of these Terms, or your violation of any rights of another party.

The Service integrates with third-party services including Google Maps, Stripe (payment processing), and Umami Analytics. Your use of these services is governed by their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, vendors, us, or third parties, or for any other reason.

You may terminate your account at any time by contacting us at [email protected]. Upon termination, your right to use the Service ceases immediately.

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Minnesota.
